Terms and Conditions

This Terms of Use Agreement (“Agreement”) is made between You, the user of the Platform, and Adivaha Shop, a company, having its registered office at 252-e, 1st Floor, Sant Nagar, East Of Kailash, New Delhi, Delhi, India 110065.

By using our website or app (together called the Platform), you agree to follow these Terms of Use. Please read them carefully.

Use of Platform

When you register or use the Platform, you accept:

• Our Privacy Policy
• Any other terms or rules we publish from time to time

We may update these terms without notice. Some services may also have additional conditions — by using them, you accept those too.

1. Access to Services

We provide services and features through our Platform for your personal use only — not for resale or third-party use. Services may include:

• Direct services by Adivaha Shop
• Hardware/products we offer
• Widgets from our Platform or third-party app stores
• All digital content shown or provided through our services

If you are using our Platform from outside India, you do so at your own discretion and must follow local laws. These Terms should not be used for unauthorized marketing or promotion in restricted regions.

2. Registration and Eligibility

To use the services provided on the Platform, you must first register with Adivaha Shop and provide true, accurate, and up-to-date information — including your name, mobile number, and email. If any information is incorrect or becomes outdated, your account may be suspended or terminated.

Registration is required only once. If you’ve already registered, just sign in with the same details.

We reserve the right to refuse or cancel usernames at our sole discretion. You’re fully responsible for keeping your password secure and for all activity under your account. Never use someone else’s account without their explicit permission. If you suspect any unauthorized access, notify us immediately.

When registering:

• You confirm you are of legal age to enter into a contract;
• Or, if registering for a company, you’re authorized to do so on its behalf.

You are responsible for ensuring that using our Platform is legal under your local laws. If use of our services is restricted where you are, do not use them.

Minors: If you're under legal age, a parent or guardian must provide consent for you to use our services. By allowing a minor to use the Platform, we assume such consent has been given. Adivaha Shop is not liable for any consequences that result from a minor misusing the Platform.

You may not:

• Provide false information or create accounts for others without permission;
• Use someone else’s name or impersonate another person;
• Use a name that is offensive, obscene, or unlawful.

3. Price and Payment

Adivaha Shop currently provides access to most Platform Services at no cost. However, this may change at any time as per the Company’s discretion.

If you opt for paid features or subscriptions, the applicable charges may be one-time or recurring monthly fees. All payments must be made in INR (Indian Rupees) — payments in any other currency are not accepted.

Despite best efforts, there may occasionally be errors in product pricing or availability.

Adivaha Shop reserves the right to cancel orders and correct pricing information at any time, even after an order is placed.

You may pay using Credit/Debit Card, Net Banking, or UPI, processed through our secure third-party payment partners.

Refunds, cancellations, or return requests will be handled according to the most recent Adivaha Shop return and refund policy.

We also reserve the right to change program rules, offers, or rewards at any time without prior notice.

4. Terms of Sale

While using the Platform may be free, Services that require payment are charged in INR. Any errors in listings may result in order cancellation. Adivaha Shop reserves the right to correct or change any product information or pricing without notice.

Purchases made are subject to our return, refund, and cancellation policies, which may be updated as needed.

5. Content

You’re responsible for the content you post or share on the Adivaha Shop Platform. We don’t take responsibility for user-submitted information, and we can’t guarantee its truthfulness or accuracy. Anything you share or access is at your own risk, and Adivaha Shop is not liable for any consequences that come from it.

“Content” includes images, videos, text, audio, comments, designs, software, and more — basically, anything you or others upload. This also includes “User Submissions,” which are any contributions made by you or other users.

You must ensure that your content doesn’t violate any third-party rights (like copyrights or trademarks) or laws. If you’re using someone else’s materials (e.g., logos, music, designs), make sure you have proper permission first.

Election-related content must follow Indian law and can’t be shared during the 48 hours before polls close in any area.

The following types of content are not allowed:

• Drugs (illegal or prescription without approval)
• Tobacco, unsafe health products
• Weapons or explosives
• Pornographic or explicit content
• Fake, pirated, or harmful products
• Animal cruelty or endangered species trade
• Organ sales or abortion services
• Gambling, betting, or lottery content (unless legally approved)
• Advertising restricted professional services (like doctors or lawyers) without required licenses

6. Company Content

Adivaha Shop owns or licenses all the content it provides, including graphics, software, text, and branding. You’re allowed to use this content only for personal, non-commercial use, and you cannot copy, sell, or modify it unless you get our written permission.

This content is provided “as is” — meaning we don’t make any guarantees about how accurate, complete, or useful it is.

7. Conditions to Use

The Services offered by Adivaha Shop are provided on a best-efforts basis. We shall make reasonable efforts to ensure that your access to and use of the Services remains uninterrupted and free from undue delays.

By creating an account with Adivaha Shop, you agree to receive promotional communications, service updates, and information regarding new offerings. You may opt out of promotional communications at any time by following the unsubscribe link provided in such communications. However, you will continue to receive essential updates related to your account and the use of Services.

When using the Platform, you may share sensitive personal information (“SPI”), such as registration details and your mobile number. Adivaha Shop is committed to handling your SPI in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and will take all necessary measures to maintain the confidentiality and security of such information.

Adivaha Shop is not liable for any harm resulting from viewing, downloading, or using Content. You are responsible for taking appropriate precautions to protect your systems from malicious content such as viruses or malware. Any content accessed is solely the responsibility of the creator or uploader, and Adivaha Shop shall bear no liability for any resulting damages.

You may request deletion of your account by contacting us at adivaha.shop@thewebconz.com.

8. Terms of Sale

As a condition for using the Services, you agree not to engage in any activity prohibited by these Terms of Use. You shall comply with all relevant local, national, and international laws and, if applicable, the self-regulatory standards of your industry.

You agree not to publish or transmit content that:

• Infringes upon third-party intellectual property or contractual rights;
• Is false, misleading, defamatory, harassing, obscene, or otherwise offensive;
• Contains unsolicited promotions, spam, or unauthorized advertisements;
• Promotes pyramid schemes, contests, or commercial sales without consent;
• Includes malware, viruses, or code that may disrupt or gain unauthorized access to systems;
• Impersonates another individual or misrepresents identity;
• Violates the Privacy Policy or other applicable platform policies.

You shall not:

• Interfere with platform operations or impose an excessive load on infrastructure;
• Attempt to bypass access restrictions or security measures;
• Use bots or scripts to scrape or extract data from the Platform;
• Modify or copy platform content without authorization;
• Reverse-engineer or attempt to extract source code from any software provided;
• Upload or distribute content you do not own or are unauthorized to modify;
• Use the Services for illegal purposes or to commit fraud;
• Disseminate malicious, harmful, or false information about the Platform or Adivaha Shop;
• Violate any policy or community guideline issued by Adivaha Shop.

By using the Services, you affirm that:

• You are 18 years or older and legally permitted to use the Platform;
• You have read, understood, and agreed to the Terms of Use and Privacy Policy;
• All information you provide is accurate, current, and complete;
• You will not use the Platform for any unlawful or unethical purposes.
• All platform software and hardware remain the sole property of Adivaha Shop, and you are granted a limited, non-exclusive right to use the Services in accordance with these Terms.
• Adivaha Shop reserves the right to access, retain, or disclose your information if required by law, for security purposes, to enforce the Terms, or to protect the rights and safety of its users and the general public.

9. Third-Party Websites and Services

Adivaha Shop connects users with retailers and distributors. Our Services may link to external websites or services, and others might link back to us. We don’t control these external sites and aren’t responsible for their content or reliability. Just because we link to something doesn’t mean we endorse it. Use them at your own risk — we’re not responsible for anything that happens as a result of you visiting or relying on those external platforms.

10. Account Termination

We may suspend or terminate your access to the Platform at any time, with or without reason. This could include deleting your data or account permanently. If you wish to close your account, just follow the steps provided on the Platform. Terms that logically continue after account closure — like ownership, limitations of liability, and legal protections — will still apply.

11. Warranty Disclaimer

We don’t guarantee:

• Who can access the Services;
• What content you’ll find;
• How it affects you or what you do with it.

You accept all risks related to content use. Some things on the Service — or links to outside sites — may not be suitable or accurate. We don’t take responsibility for this, or for failed transactions, or for any harm that results from interacting with people through our Platform.

Everything is provided “as is” and “as available.” That means:

• No guarantees it’ll always be working or secure;
• No promises that issues will be fixed;
• No assurance content is free of harmful elements.

Some places don’t allow these disclaimers, so some parts might not apply to you.

12. Indemnification

If you misuse the Service, break our Terms, or harm someone else’s rights, you agree to protect Adivaha Shop and everyone working with us from legal trouble, costs, and damages. If a legal issue arises, we may take over the defense, and you agree to cooperate.

13. Terms of Sale

Adivaha Shop isn’t responsible for:

• Any failed or incomplete transactions;
• Delays or failures caused by unexpected events beyond our control (like natural disasters or strikes);
• Delays caused by third parties or partners;
• Whether the Platform fits your personal needs — it’s your responsibility to check;
• Any viruses or damage to your data or device caused while using the Platform.

Remember, even if your data is encrypted, it can still potentially be intercepted over the internet. So use with caution.

In some places, legal limits on liability may not apply — but where they do, Adivaha Shop's responsibility will be as limited as the law allows.

Also, our team members, directors, or suppliers won’t be held personally responsible.

We're not liable for:

• Not being able to use the service;
• Indirect or unexpected losses;
• Lost profits or revenue;
• Data loss or costs related to getting alternatives;
• Anything else related to your use of the Platform.

14. Copyright and Trademarks

All content and designs on the Platform belong to Adivaha Shop, unless otherwise noted. You can use the Platform, but only for personal, non-commercial purposes.

Don’t copy, upload, share, or change any part of the Platform without our permission. Don’t misuse the Platform in any way — including hacking, spamming, or trying to break it.

You also can’t reverse engineer or tamper with the tech. Use it within the laws of your country.

15. Governing Law

These Terms follow the laws of India. Legal issues must be brought within a year of when they happen.

If there's a dispute, courts in Bengaluru will have jurisdiction. However, we’ll first try to resolve it through arbitration as per Indian law. One arbitrator, appointed by Adivaha Shop, will handle the case. Arbitration will be in English and take place at [insert location].

Even with arbitration, we can still go to court for temporary legal protections if needed.
